Nachstehend finden Sie die Vereinbarungen, die mit den Allgemeinen Geschäftsbedingungen getroffen werden:
1. Allgemeines
Parteien:
„Kaospilot+ Berlin“ steht für The New Chaos UG (haftungsbeschränkt). Die Adresse von The New Chaos UG ist Engeldamm 70, 10179 Berlin.
Im Rahmen dieser Geschäftsbedingungen bezieht sich „wir“ auf Kaospilot+ Berlin, „uns“ und „unser“ werden ebenfalls in der entsprechenden Bedeutung verwendet; „Sie“ bezieht sich auf den Kunden, „ihn“ und „sein/e/n/es“ werden ebenfalls in der entsprechenden Bedeutung verwendet.
Geltungsbereich:
Diese Bedingungen regeln (in Kombination mit den Dokumenten, auf die hier verwiesen wird) die Geschäftsbedingungen, auf deren Grundlage Kaospilot+ Berlin die vom Kunden bestellten Produkte und Services bereitstellt. Kaospilot+ Berlin weist darauf hin, dass sich der Kunde durch die Bestellung der Produkte zur Einhaltung dieser Bedingungen verpflichtet. Deshalb sollten diese Bedingungen zur späteren Verwendung aufbewahrt werden.
2. Vertragsschluss
Der Kundenauftrag gilt als Angebot zum Kauf von Produkten gemäß diesen Bedingungen; es steht Kaospilot+ Berlin frei, dieses Angebot nach eigenem Ermessen anzunehmen oder abzulehnen. Kaospilot+ Berlin nimmt das Angebot durch Zusendung einer Auftragsbestätigung oder einer Rechnung an (der “Vertragsschluss”). Ein Vertragsschluss kommt ebenfalls zustande, sobald der Kunde eine vollständige Zahlung des Produkts auf Grundlage einer von Kaospilot+ Berlin zur Verfügung gestellten Zahlungsoption bewirkt.
3. Zahlung
Der Preis eines Produkts/Services ist in voller Höhe innerhalb von 14 Tagen ab Auftragsdatum oder gemäß einer im Auftrag anderslautenden Vereinbarung fällig, wobei die fristgemäße Zahlung Voraussetzung für die Erfüllung der vorliegenden Bedingungen ist.
Wird die Zahlungen nicht gemäß der Frist geleistet, behält Kaospilot+ Berlin sich das Recht vor, die Erbringung der Dienstleistungen und den Online-Zugang solange einzustellen bzw. zu sperren, bis die entsprechende Zahlung ordnungsgemäß eingegangen ist.
4. Produkte, Services und Dienstleistungen
Kaospilot+ Berlin gewährt bei Vertragsschluss den Online-Zugang und sendet die Anmeldedaten an die bereitgestellten E-Mail-Adressen der benannten Einzelnutzer.
Der Kunde übernimmt die volle Verantwortung dafür, dass die benannten Einzelnutzer wissen, für welche Produkte sie angemeldet wurden, dass sie die Teilnahmekriterien erfüllen und dass es sich um für die Produkte geeignete Kandidaten handelt. Sollten die Teilnahmekriterien (zB Verifizierung von Studenten für Angebote, die lediglich Studenten behält sich Kaospilot+ Berlin das Recht vor, die Erbringung der Dienstleistungen und den Online-Zugang solange einzustellen bzw. zu sperren, bis die entsprechende Verifizierung eingegangen ist. Die entsprechende Möglichkeiten für die Verifizierung werden in Angeboten für Studenten aufgeführt.
Die benannten Einzelnutzer müssen sich in der Online-Lernumgebung registrieren, um auf die Materialien zugreifen und den Kurs abschließen zu können. Jegliche Zugänge werden von Kaospilot+ Berlin erstellt, bereitgestellt bzw. als Einladung zu diversen Plattformen versendet.
Es wird keine Gewähr dafür übernommen, dass der Online-Zugang unterbrechungsfrei oder vollkommen fehlerfrei erfolgt oder, dass eventuelle Fehler beim Zugang umgehend behoben werden können. Für den Fall erheblicher Zugangsstörungen, die die Lernerfahrung beeinträchtigen, bemüht Kaospilot+ Berlin sich um die Einrichtung von Notfallplänen, um die erwarteten Schulungsmöglichkeiten im vollen Umfang zu erfüllen.
5. Rechte am geistigen Eigentum
Die Rechte am geistigen Eigentum in Produkten, Materialien und der Online-Lernumgebung liegen und verbleiben beim Schulungsanbieter oder seinen Lizenzgebern.
Wenn in diesen Bedingungen nicht ausdrücklich angegeben, erwirbt der Kunde keinerlei Rechte am geistigen Eigentum der Produkte, Materialien, der Online-Lernumgebung, der Teilnehmerergebnisse oder der Software. Der Kunde erklärt, dass er die Produkte oder Teile der Produkte nicht vermieten, verleasen, Unterlizenzen vergeben, verleihen, kopieren, verändern, übersetzen, zurückentwickeln, dekompilieren, zerlegen oder davon abgeleitete Werke schaffen und die Produkte weder ganz noch in Teilen (außer wie in diesen Bedingungen beschrieben) verwenden, reproduzieren oder damit handeln darf, es sei denn ihm stehen entsprechende gesetzliche Rechte zu, die nicht abdingbar sind.
Mit der Zustimmung zu diesen Bedingungen und der Annahme des Angebots des Kunden verpflichtet sich Kaospilot+ Berlin, dem Kunden eine begrenzte, nicht ausschließliche, nicht übertragbare, widerrufliche Nutzungslizenz für das/die Produkt/e und Teilnehmerergebnisse zu gewähren, welche ausschließlich zur Nutzung durch benannte Einzelnutzer zum Zwecke des Abschlusses der Produkte bestimmt ist.
6. Inhalte Dritter
Im Rahmen der Produktbereitstellung kann Kaospilot+ Berlin über Verknüpfungen auf Inhalte Dritter verweisen. Dies bedeutet, dass benannte Einzelnutzer ggf. Kaospilot+ Berlin's Seite verlassen und auf Websites gelangen, die nicht von Kaospilot+ Berlin betrieben werden. Kaospilot+ Berlin haftet nicht für die Inhalte oder die Verfügbarkeit verknüpfter Seiten.
Für die Inhalte verknüpfter Drittanbieter-Websites übernimmt Kaospilot+ Berlin keine Verantwortung. Kaospilot+ Berlin vertritt diese Drittparteien nicht und empfiehlt oder garantiert deren Produkte nicht. Kaospilot+ Berlin kann keine Haftung für die Richtigkeit der Angaben auf den verknüpften Seiten übernehmen. Der Kunde und die benannten Einzelnutzer sollten Informationen verknüpfter Websites stets prüfen, bevor sie darauf vertrauen.
Da die Sicherheits- und Datenschutzrichtlinien dieser Seiten sich von denen von Kaospilot+ Berlin unterscheiden können, sollten die Sicherheits- und Datenschutzrichtlinien der Drittanbieter aufmerksam gelesen werden.
Bei Fragen und Anliegen hinsichtlich der auf den verknüpften Websites von Dritten angebotenen Produkte und Dienstleistungen ist der jeweilige Drittanbieter zuständig.
7. Widerrufsrecht
Soweit der Kunde Verbraucher im Sinne des § 13 Bürgerliches Gesetzbuch (BGB) ist, also eine natürliche Person, die ein Rechtsgeschäft zu Zwecken abschließt, die überwiegend weder ihrer gewerblichen noch ihrer selbstständigen beruflichen Tätigkeit zugerechnet werden können, steht ihm ein gesetzliches Widerrufsrecht zu.
Der Kunde hat das Recht, binnen vierzehn Tagen ohne Angabe von Gründen den Vertrag zu widerrufen. Die Widerrufsfrist beträgt vierzehn Tage ab dem Tag des Vertragsabschlusses. Um das Widerrufsrecht auszuüben, muss der Kunde Kaospilot+ Berlin (Kaospilot+ Berlin, Edda Kruse Rosset, Engeldamm 70, 10179 Berlin; E-Mail: contact@kaospilot.de) mittels einer eindeutigen Erklärung (z.B. Brief oder E-Mail) über den Entschluss informieren, den Vertrag zu widerrufen.
Wenn der Kunde den Vertrag widerruft, wird Kaospilot+ Berlin alle Zahlungen, die wir vom Kunden erhalten haben, unverzüglich und spätestens binnen vierzehn Tagen ab dem Tag zurückzuzahlen.

The following terms are applicable for any products that you purchased with us:
1. General:
**Parties:**
"Kaospilot+ Berlin" stands for The New Chaos UG. The address of The New Chaos UG is Engeldamm 70, 10179 Berlin. In these terms and conditions, "we" refers to Kaospilot+ Berlin, "us" and "our" are also used in the appropriate meaning; "you" refers to the customer, "him" and "his" are also used in the appropriate meaning.
**Area of validity:**
These Terms and Conditions shall govern (in combination with the documents referred to herein) the terms and conditions on the basis of which Kaospilot+ Berlin provides the products and services ordered by the Customer. Kaospilot+ Berlin points out that by ordering the products, the customer undertakes to comply with these conditions. Therefore, these terms and conditions should be kept for later use.
2. conclusion of contract:
The customer order shall be deemed to be an offer to purchase products in accordance with these terms and conditions; Kaospilot+ Berlin shall be free to accept or reject this offer at its own discretion. Kaospilot+ Berlin accepts the offer by sending an order confirmation or an invoice (the "conclusion of contract"). A contract shall also be concluded as soon as the customer effects full payment of the product on the basis of a payment option provided by Kaospilot+ Berlin.
3. payment:
The price of a product/service shall be due in full within 14 days of the date of the order or according to an agreement to the contrary in the order, whereby payment in due time shall be a prerequisite for the fulfilment of these Terms and Conditions. If payments are not made in accordance with the deadline, Kaospilot+ Berlin reserves the right to suspend or block the provision of services and online access until the corresponding payment has been duly received.
4. products, services and performances:
Kaospilot+ Berlin shall grant online access upon conclusion of the contract and shall send the registration data to the e-mail addresses of the named individual Users provided. The Customer shall assume full responsibility for ensuring that the named Individual Users know for which products they have been registered, that they meet the participation criteria and that they are suitable candidates for the products. If the participation criteria (e.g. verification of students for offers which are only for students) are not met, Kaospilot+ Berlin reserves the right to suspend or block the provision of services and online access until the corresponding verification has been received. The corresponding possibilities for verification are listed in offers for students. The named individual users must register in the online learning environment in order to access the materials and to complete the course. All accesses will be created and provided by Kaospilot+ Berlin or sent out as invitations to various platforms. Kaospilot+ Berlin does not guarantee that the online access will be uninterrupted or completely error-free or that any errors in access can be corrected immediately. In the event of significant access disruptions which impair the learning experience, Kaospilot+ Berlin shall endeavour to set up emergency plans in order to fully meet the expected training opportunities.
5. intellectual property rights:
The intellectual property rights in products, materials and the online learning environment are and remain with the training provider or its licensors. Unless expressly stated in these terms and conditions, the customer does not acquire any intellectual property rights in the products, materials, online learning environment, participant results or software. Customer agrees that Customer shall not rent, lease, sublicense, loan, copy, modify, translate, reverse engineer, decompile, disassemble or create derivative works based on the Products or any part of the Products, or use, reproduce or trade in the Products in whole or in part (except as described in these Terms), except to the extent that Customer has appropriate legal rights which are not enforceable. By agreeing to these Terms and Conditions and accepting the Customer's offer, Kaospilot+ Berlin undertakes to grant the Customer a limited, non-exclusive, non-transferable, revocable liscence to use the product(s) and Participant Results, which is intended solely for use by named Individual Users for the purpose of concluding the Products.
6. contents of third parties:
Within the scope of product provision, Kaospilot+ Berlin may refer to third party content via links. This means that named individual users may leave Kaospilot+ Berlin's site and go to websites which are not operated by Kaospilot+ Berlin. Kaospilot+ Berlin is not liable for the contents or the availability of linked sites. Kaospilot+ Berlin shall not be responsible for the contents of linked third-party websites. Kaospilot+ Berlin does not represent these third parties and does not recommend or guarantee their products. Kaospilot+ Berlion cannot assume any liability for the correctness of the information on the linked sites. The customer and the named individual users should always check information of linked websites before relying on it. Since the security and privacy policies of these sites may differ from those of Kaospilot+ Berlin, the security and privacy policies of the third party providers should be read carefully. If you have any questions or concerns regarding the products and services offered on the linked websites of third parties, the respective third party provider is responsible.
7. right of withdrawal:
If the customer is a consumer in the sense of § 13 of the German Civil Code (BGB), i.e. a natural person who concludes a legal transaction for purposes that can predominantly be attributed neither to his commercial nor his independent professional activity, he is entitled to a statutory right of revocation. The customer has the right to revoke the contract within fourteen days without giving reasons. The revocation period is fourteen days from the date of conclusion of the contract. In order to exercise the right of revocation, the customer must inform Kaospilot+ Berlin (Kaospilot+ Berlin, Edda Kruse Rosset, Engeldamm 70, 10179 Berlin; E-Mail: contact@kaospilot.de) by means of a clear declaration (e.g. letter or e-mail) of the decision to revoke the contract. If the customer revokes the contract, Kaospilot+ Berlin will refund all payments received from the customer without delay and at the latest within fourteen days of the date of revocation.
